FINANCIAL TERMS OVERVIEW: RATES, REPAYMENT, AND CHARGES

What follows is a general overview of the financial terms that may appear within the Services. Flash Advance is a matching platform and does not act as a lender or set credit terms. The actual rates, fees, and conditions for any financial product are set solely by the independent provider you choose and will be disclosed to you by that provider before you enter into any agreement.

A) Annual Percentage Rate (APR)

The APR reflects the yearly cost of borrowing, shown as a percentage, and may include interest together with certain applicable charges. Depending on your qualifications and the provider’s offer, the APR for products surfaced through the Services may be as high as 35%. The provider will disclose the APR and any related fees before you move forward with an application.

B) Repayment Terms

Repayment timelines vary based on the provider, the type of product, and state law. As a general matter, repayment periods range from 3 to 24 months, depending on the option you select and what your state allows. Your payment schedule, exact due dates, and total amount owed will be provided by the provider before you complete any application or accept an offer.

C) Fees and Other Charges

Providers may charge a range of fees — for example, origination fees, late-payment fees, returned-payment or non-sufficient-funds (NSF) fees, or optional fees for expedited funding. The full fee structure and the total cost of credit will be disclosed by the provider before you accept any offer.

These Terms of Use (the “Terms”) create a legally binding agreement between you (“you,” “your,” or “User”) and Flash Advance Lending LLC (“Flash Advance,” “we,” “us,” or “our”). They govern your access to and use of the Flash Advance website (flashadvancelending.com), any mobile application we offer, and all related services (collectively, the “Services”).

By accessing, downloading, installing, opening, or otherwise using the Services, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Services.

1. Key Disclosures

1.1 Flash Advance Is Not a Lender

Flash Advance is a matching and comparison platform. We do not:

lend money or fund loans,
set interest rates, fee schedules, repayment timelines, or any other credit terms,
make credit decisions or determine your eligibility for any financial product.

Any loan, cash advance, or other financial product you decide to pursue is offered by an independent third-party provider, and your contract is directly with that provider.

1.2 No Guarantee of Approval or Funding

Product availability, approval results, funding speed, and final terms are decided solely by the provider and may differ based on the state where you live, your individual qualifications, and the provider’s requirements. We make no promise or guarantee that you will receive an offer or obtain funding.

2. Eligibility and Your Responsibilities

To access and use the Services, you must:

be at least 18 years old (or the age of majority in your state, if that age is higher),
be physically located in the United States,
use the Services only for lawful, personal, non-commercial purposes,
provide information that is accurate, current, and complete when requested.

You are responsible for protecting any verification codes or authentication methods connected with your use of the Services, and for all activity that takes place through your device.

3. What the Services Do

The Services are built to help you find and compare available cash advance and personal loan options. Depending on the flow, you may:

enter a desired amount and basic details to view available options,
review key terms shown within the Services,
decide to continue to a third-party provider’s platform to apply or proceed.

If you move forward with a provider, that provider’s terms, privacy policy, and application process govern your interaction from that point on. Flash Advance is not responsible for any provider’s products, services, decisions, or customer support.

4. Electronic Communications and Text Messages (SMS)

By using the Services, you agree to receive electronic communications connected with your use, which may include:

in-app notifications,
emails,
text messages (SMS), including one-time verification codes.

If you choose phone-based verification, we may send a one-time code to the number you provide in order to confirm your identity. Your carrier’s standard messaging and data rates may apply. If you would rather not receive verification-related texts, please do not use the phone verification feature.

We may continue to send communications that are necessary to operate the Services, respond to support requests, or comply with legal requirements.

5. Information You Submit and Your Authorization

When you submit information through the Services, you authorize us to:

process your information in order to provide the Services,
pass the information you provide to third-party providers you choose to engage with,
use service providers (including hosting, analytics, fraud-prevention, and customer-support vendors) to operate and secure the Services.

You represent and warrant that the information you submit is truthful, accurate, and not misleading. Providing false or incomplete information may lead to limited access to certain features or suspension of your use of the Services.

6. Acceptable Use and Prohibited Conduct

You agree that you will not:

use the Services in a way that violates any applicable law or regulation,
attempt to gain unauthorized access to systems, accounts, or data,
use automated tools, bots, scrapers, or crawlers to pull data from the Services,
upload or transmit malware, viruses, or other harmful code,
reverse engineer, decompile, disassemble, or otherwise try to derive the source code of the Services,
copy, modify, distribute, or create derivative works from the Services or their content without our prior written consent,
use the Services to send spam, unsolicited advertising, or unlawful communications.

We reserve the right to suspend or terminate your access if we reasonably conclude that you have violated these Terms or engaged in fraudulent, abusive, or prohibited activity.

7. Fees and Compensation

7.1 No Charge to You

We do not charge you any direct fee to access or use the Services.

7.2 Compensation From Providers

We may receive compensation from third-party providers — such as referral fees or marketing commissions — when users click through, submit applications, or complete certain actions with a provider. Any such compensation does not change the terms or pricing the provider offers to you.

8. Third-Party Sites and Providers

The Services may link you to external websites or provider platforms. We do not control and are not responsible for the content, availability, privacy practices, products, or services offered by third parties. Your relationship with any provider is governed entirely by that provider’s own agreements and disclosures.

9. Intellectual Property

The Services and all related content — including text, graphics, logos, software, design elements, and compilations — belong to Flash Advance Lending LLC or its licensors and are protected by applicable intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for personal, lawful purposes in line with these Terms. This license does not allow you to sublicense, resell, or otherwise commercially exploit any part of the Services.

10. Disclaimers

THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Services will run without interruption or error, that they will be completely secure, or that any information displayed will always be current or available.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLASH ADVANCE LENDING LLC AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, NOR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF (OR INABILITY TO USE) THE SERVICES OR ANY THIRD-PARTY PROVIDER.

IF ANY LIABILITY IS ESTABLISHED DESPITE THE FOREGOING, OUR TOTAL CUMULATIVE LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (USD $100).

Some states do not allow certain limitations of liability, so parts of this section may not apply to you.

12. Indemnification

You agree to defend, indemnify, and hold harmless Flash Advance Lending LLC and its affiliates, officers, directors, employees, partners, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) that arise out of or relate to:

your use or misuse of the Services,
your breach of these Terms,
your violation of any applicable law or regulation,
your infringement or violation of any right of any third party.

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Wyoming, without regard to conflict-of-law principles, together with applicable federal law.

13.2 Binding Individual Arbitration; Class Action Waiver

Except where prohibited by law, any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved through final and binding arbitration on an individual basis, administered under the Federal Arbitration Act, rather than in court.

You agree that:

no class actions, class arbitrations, or representative proceedings may be brought,
claims may be brought only in your individual capacity.

If arbitration is found to be unenforceable for a particular claim, that claim will be resolved in a court of competent jurisdiction, while all remaining claims will continue to be subject to arbitration to the fullest extent permitted by law.

14. Termination

We may suspend or terminate your access to the Services at any time if we believe you have violated these Terms or if your continued use creates a risk to us, to providers, or to other users.

You may stop using the Services at any time by deleting the application (if applicable) and discontinuing all use.

Provisions of these Terms that by their nature are meant to survive termination — including disclaimers, limitation of liability, indemnification, and dispute resolution — will remain in full force and effect.

15. Changes to These Terms

We may revise these Terms from time to time. When we do, we will update the Effective Date shown at the top of this page. By continuing to use the Services after the changes take effect, you accept the revised Terms. If you do not agree with the revised Terms, you must stop using the Services.

16. Apple-Specific Provisions (iOS Users)

If you access the Services through an iOS application, these Terms are an agreement between you and Flash Advance Lending LLC, not with Apple Inc. Apple has no responsibility for the Services or their content and is under no obligation to provide any maintenance or support services.
